Refund and Cancellation Policy

Effective Date: 1st January 2026

 

This Refund and Cancellation Policy applies to all services and products offered through artenity.com and by Artenity ("we", "our", "us"). By engaging our services, booking a consultation, or purchasing any product, you agree to the terms outlined below.

1. GENERAL POLICY

Artenity offers both customised artistic services and ready-made products.

Custom services include made-to-order artworks, wall murals, textured art, hand-painted projects, and creative consultations.

Ready-made products include finished, pre-designed items available for direct purchase through the website, including pouches, bags, accessories, and lifestyle products featuring hand-made or hand-painted artwork.

Refunds, cancellations, and returns are governed strictly by this policy and differ based on whether the purchase is a service or a ready-made product.

2. CONSULTATION FEES

Consultation fees, site visit fees, and concept discussion fees are non-refundable.

A consultation fee covers time, expertise, travel if applicable, and preliminary creative input.

Payment of a consultation fee does not guarantee project confirmation or final execution.

3. PROJECT BOOKINGS AND ADVANCE PAYMENTS

An advance payment is required to confirm any project booking.

Once a project is confirmed and advance payment is received, the booking is considered final.

Advance payments are non-refundable under all circumstances unless explicitly agreed in writing by Artenity.

4. CANCELLATION BY CLIENT

If the client chooses to cancel the project:

Before work has commenced: Advance payment remains non-refundable.

After work has commenced: No refund shall be provided and the client may be liable for additional costs already incurred.

After design approval or material procurement: No refund will be issued under any circumstances.

5. CANCELLATION OR RESCHEDULING BY ARTENITY

Artenity reserves the right to reschedule or cancel a project due to unforeseen circumstances, including health or safety concerns, force majeure events, government restrictions, or unavoidable logistical or material constraints.

In such cases, the project may be rescheduled to a mutually agreed date, or any amount paid for work not commenced may be adjusted or refunded at Artenity’s discretion.

6. DELAYS AND CLIENT RESPONSIBILITIES

Refunds shall not be issued for delays caused by incomplete or delayed information from the client, site unavailability or access restrictions, changes requested after approval, or delays caused by third-party vendors or contractors engaged by the client.

7. CHANGES AND REVISIONS

Minor revisions may be accommodated at Artenity’s discretion.

Major changes requested after concept or design approval may attract additional charges.

Requests for changes do not qualify for refunds.

8. DISSATISFACTION WITH ARTISTIC OUTPUT (CUSTOM SERVICES)

Art is subjective by nature.

Refunds will not be issued based on personal taste, change of mind, or subjective dissatisfaction once work has commenced or completed.

All custom projects are executed based on approved concepts, references, and mutual discussions.

9. READY-MADE PRODUCTS – RETURNS, REFUNDS AND REPLACEMENTS

This section applies only to ready-made products purchased directly from artenity.com, including pouches, bags, accessories, and other items featuring hand-made or hand-painted artwork.

 

a. Eligibility for Returns:

Returns are accepted only if the product is received in a damaged, defective, or incorrect condition.

The customer must notify Artenity within 48 hours of delivery with clear photographs or videos as proof.

Products must be unused, in original condition, and in original packaging.

 

b. Hand-Made and Hand-Painted Products Disclaimer:

Each hand-made or hand-painted item is unique by nature.

Minor variations in colour, brush strokes, texture, finish, or placement of artwork are natural characteristics and shall not be considered defects. Such variations do not qualify for returns, refunds, or exchanges.

 

c. Non-Returnable Items:

Products purchased on sale, discount, or promotional offers.

Items damaged due to misuse, mishandling, exposure to moisture, improper care, or normal wear and tear.

Minor variations arising from hand-crafted processes or screen and display colour differences.

 

d. Refunds and Replacements:

Once a return request is approved, Artenity may offer a replacement or refund at its discretion.

Approved refunds will be processed to the original mode of payment within 7 to 10 working days after verification.

Shipping and handling charges are non-refundable unless the return is due to an error by Artenity.

10. PAYMENT DISPUTES AND CHARGEBACKS

Initiating a chargeback or payment dispute without first contacting Artenity may result in legal action.

Any costs incurred due to unjustified chargebacks shall be borne by the customer.

11. GOVERNING LAW AND JURISDICTION

This policy shall be governed by and construed in accordance with the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal.
